Advanced questions had been submitted by Councillor Shields. Councillor Shields was in attendance at the meeting but was unable to put the questions in person due to technical issues.
Councillor Stuart Richardson read out Councillor Shield’s questions and then responded:

1) Why is a decision being taken around consultation whilst we are still under restrictions from the COVID pandemic on something as important as the SCI?

Response:
The revised SCI is being consulted on to allow for planning documents to be consulted on during the COVID pandemic so as not to hold up the consultation on key planning documents. This approach has been used by a large number of local planning authorities to allow the production of key planning documents to continue. The SCI consultation will still be advertised widely and hard copies of the documents made available in libraries as well as on the planning policy pages of the website. Representations to the document can still made by letter although electronic submissions are encouraged.

2) The SCI has been updated to take into account the current social distancing measures. Will it therefore need to be updated again when these restrictions have been lifted? If it is so should it not be on this document explaining the process for how this will happen?

Response:
The SCI has been drafted to set out that these measures may be used in times of restrictions, otherwise all methods of consultation set out in the SCI will be used. Page 4 of the document sets out the Governments response with the changes that allow the planning system to operate during the Covid 19 pandemic that remain in force until the 31st December 2021.

3) What changes to the draft document you are proposing, are different from the draft document presented to OS Place on the 21 st Feb 2021?

Response
The same document that was presented to OSC 21st February is being proposed to be consulted on.

4) Is it necessary for the whole document to go out to consultation when we have a document from 2017 which was previously consulted on and adopted, why is there a need for the whole document to be consulted on when only the amendments to an existing adopted document are necessary?

Response:
As members of the public can see how the changes fit into the full SCI.

5) A number of suggestions were put forward at the OS meeting in February to be included as members were not happy and felt they could not support the draft document as it was presented. I can see no changes to include these items. Why have the comments from OS not been incorporated into the document you as Portfolio Holder are putting forward for consultation.

Response:
Members of the OSC committee agreed that the document would be forwarded to the Portfolio Holder for a delegated decision to go out to consultation for a six week period. All of the representations to the consultation will be reviewed and any necessary changes can be made to the document before being reviewed by the Portfolio Holder for Regeneration and Growth for adoption.

6) On what date do you intend to start the consultation process as again there is no date for this period to commence in the delegated decision you are taking?

Response:
The consultation is due to start on Friday 11th June 2021.



 
21/08STATEMENT OF COMMUNITY INVOLVEMENT 2021 APPROVAL FOR 6 WEEK CONSULTATION PERIODSTATEMENT OF COMMUNITY INVOLVEMENT 2021 APPROVAL FOR 6 WEEK CONSULTATION PERIOD

The Senior Planning Policy Officer presented a summary of the report. The Officer advised that the main aim of the Statement of Community Involvement was to encourage people to engage with the planning process.

The council’s Statement of Community Involvement (SCI) sets out how and when people are able to get involved with the planning system. It covers both planning policy related consultations (such as the Local Plan) and planning applications, and is a requirement of Section 18 of the Planning and Compulsory Purchase Act 2004.

The council currently has a Statement of Community Involvement which was adopted in July 2017, following public consultation.

The draft SCI was considered by the Overview and Scrutiny Committee (Place) on 23 February 2021 and it was agreed that the document would to go to the Portfolio Holder for Regeneration for a delegated decision to confirm a six week consultation period.

The Officer advised that due to the ongoing restrictions due to Covid 19 the requirements of the Mansfield District Council SCI could not be complied with. It is therefore important that the SCI be revised to allow for consultations to continue should there be further Covid 19 restrictions. The draft SCI (Appendix A sets out how this can be done digitally (online) methods could include video conferencing etc.

Other methods would be adopted to ensure that the information would be available to all including those without online access e.g. letters and press releases.
The Officer recommendations were:
That the draft Statement of Community Involvement, as outlined in Appendix A, be consulted on for a six week period. (Following this period the Statement of Community Involvement is to be adopted by the Portfolio Holder for Regeneration, subject to any proposed changes being agreed).
The Portfolio Holder for Regeneration and Growth asked for clarification regarding what would happen if restrictions were not lifted that would allow for face to face consultation to take place.
The Officer responded that there would be at least 2 planned outdoor events after 21 June 2021 if restrictions had not been lifted.
The Portfolio Holder for Regeneration and Growth stated that with the addition of at least 2 outdoor consultations that he would be approve the recommendations and authorise the Decision Notice.

RESOLVED BY THE PORTFOLIO HOLDER FOR REGERNATION AND GROWTH:

Resolved by the Portfolio Holder for Regeneration and Growth

i) That the draft Statement of Community Involvement, as outlined in Appendix A, be consulted on for a six week period. At least 2 physical consultation events will be held by officers when the current Covid 19 restrictions are lifted. In line with step 4 of the Government Roadmap to recovery this will be no sooner than 21 June 2021,

ii) Following this period the Statement of Community Involvement be adopted by the Portfolio Holder for Regeneration, subject to any proposed changes being agreed.
