The Minutes of the Meeting held on 20 January, 2022 were submitted for confirmation.

Councillor Walker expressed concern that the minutes were not an accurate account of the meeting.

On the minutes being put to the vote the result was 5 votes in favour with 1 vote against and 0 abstentions.

22/06LICENSING ACTIVITY UPDATE LICENSING ACTIVITY UPDATE

The Licensing Manager provided members with an update on key areas of work within the Licensing Team.

The Licensing Team had recently been working with the Police and had taken part in Amberstag, the town centre partnership operation also referred to as ‘Days of Action’. The Team were also working in partnership with the trade and the police to reduce the number of under age people getting into venues using fake identification or identification that does not belong to them.

Members were advised that Government had confirmed an extension to licensing hours for the Queen's Jubilee weekend which would apply to premises already licensed until 11.00 p.m. The Order would extend the licensing hours for such premises from 11.00 p.m. to 1.00 a.m. the following day on Thursday, 2 June, Friday, 3 June, and Saturday, 4 June, 2022.

The Committee were informed that Tax checks for licence holders came into effect from the 4 April, 2022. This applied to taxi driver licences, private hire driver licences, and private hire vehicle operator licences. Licensing authorities must carry out extra checks if an individual, company or any type of partnership applying for a licence.

Members were advised that harsher sentences had been introduced for GHB, a drug that is used to spike drinks, which had also been reclassified as a Class B drug along with two related substances, GBL and 1,4-BD. From 13 April, 2022, those found in unlawful possession of these drugs would face tougher sentences of up to five years in prison, while those involved in supply and production would face up to 14 years in prison.

22/07CARAVAN SITES – FIT AND PROPER PERSON TEST FEE POLICY REVIEWCARAVAN SITES – FIT AND PROPER PERSON TEST FEE POLICY REVIEW

The Licensing Manager presented her report outlining the requirements for adopting a procedure to assist in the assessment of “Fit and Proper Persons” to manage a caravan site and to set an appropriate fee under a Fees Policy for carrying out such an assessment and inclusion of refusal onto the register. The report also proposed to update all other fees charged in respect of Park Homes, under the Park Homes Fees Policy.

Councillor Anderson proposed and Councillor Drewett seconded that:
(i) That the amendments to the Park Homes Fees Policy be approved (this includes the addition of fees in respect of the Fit and Proper Person Assessment FPPA)
(ii) That Members give approval for the amendment/introduction of fees to commence immediately.
(iii) Authority is delegated to the Licensing Manager to determine applications under the FPPA procedure and reviews of determinations under FPPA are delegated to the Head of Health and Communities.
(iv) Authority is further delegated to the Licensing Manager and/or Head of Health and Communities, in consultation with the Chair of Licensing to make any minor amendments to the FPPA procedure that may be necessary when it is reviewed.

The motion being put to the vote the motion was carried unanimously.

RESOLVED -

(i) That the amendments to the Park Homes Fees Policy be approved (this includes the addition of fees in respect of the Fit and Proper Person Assessment FPPA)

(ii) That Members give approval for the amendment/introduction of fees to commence immediately.

(iii) Authority is delegated to the Licensing Manager to determine applications under the FPPA procedure and reviews of determinations under FPPA are delegated to the Head of Health and Communities.

(iv) Authority is further delegated to the Licensing Manager and/or Head of Health and Communities, in consultation with the Chair of Licensing to make any minor amendments to the FPPA procedure that may be necessary when it is reviewed.
