22/04TO APPROVE A 6 WEEK PERIOD OF PUBLIC CONSULTATION FOR THE DRAFT PLANNING OBLIGATIONS SUPPLEMENTARY PLANNING DOCUMENT TO APPROVE A 6 WEEK PERIOD OF PUBLIC CONSULTATION FOR THE DRAFT PLANNING OBLIGATIONS SUPPLEMENTARY PLANNING DOCUMENT

The Planning Policy Team Leader presented a summary of the Draft Planning Obligations Supplementary Document. The Portfolio Holder for Regeneration and Growth was advised that the Draft Planning Obligations Supplementary Planning Document (SPD) set out the district council’s approach to securing planning obligations that were required to mitigate the impact of development within the district. It provides clarity on the types of obligations that may be sought for district council infrastructure along with those that the Clinical Commissioning Group (CCG) may seek for health infrastructure. To provide certainty as to the contributions that it may seek, the SPD also incorporates a link to the county council’s Developer Contributions Strategy.

The purpose of the report was to seek approval for the Draft Supplementary Planning Document to go out for a 6-week period of public consultation.

The Portfolio Holder for Regeneration queried if there had been any changes to the Appeal process.

The Planning Policy Team Leader advised that there were no changes to the Appeal Process. The document set out the process.

The Portfolio Holder for Regeneration and Growth asked for clarification of the obligations stated within the report and asked if this was related to the Section 106 Agreement.

The Planning Policy Team Leader clarified that it was related to the Section 106 Agreement and advised that this sets out all of the planning obligations, and the process followed for contribution updates.

The Member queried if this was very different as to the process followed in previous years.

The Planning Policy Team Leader advised that it was not. However, this was to bring the document up to date with the Local Plan. The figures would be used to confirm Local Plan viability.

The Member queried if the SIL Levi was included.

The Officer advised that the authority use Section 106 rather than having a district wide SIL. This was something that would remain under review.

The Portfolio Holder for Regeneration and Growth having read the report was satisfied with the contents and authorised the for the draft Planning Obligations SPD, as appended to the report be approved for a 6 week period of public consultation in line with the Council’s Statement of Community Involvement.

22/05STATEMENT OF COMMUNITY INVOLVEMENT (SCISTATEMENT OF COMMUNITY INVOLVEMENT (SCI

The Planning Policy Team Leader presented a summary of the Statement of Community Involvement Report to the Portfolio Holder for Regeneration and Growth.
The Portfolio Holder for Regeneration and Growth was informed that the Statement of Community Involvement (SCI) set out how and when people are able to get involved with the planning system. It covers both planning policy related consultations (such as the Local Plan) and planning applications, and is a requirement of Section 18 of the Planning and Compulsory Purchase Act 2004.

Planning policy related consultations (including the Local Plan review, supplementary planning documents (SPDs) and any masterplans) need to be carried out in accordance with the SCI.

Local planning authorities must review their SCI’s every five years.

The council currently has a Statement of Community Involvement which was adopted in July 2017, following public consultation.

The revised SCI was considered by the Overview and Scrutiny Committee (Place) on 21 December 2021 following a six week public consultation exercise. It was agreed that the document would to go to the Portfolio Holder for Regeneration and Growth for a delegated decision to adopt the document.

The Portfolio Holder for Regeneration and Growth asked if there had been any specific comments received following the consolation.
The Planning and Policy Team Leader advised that 17 comments had been received and all comments were listed in section 9.3 of the report. The main changes made were as a result of the public consultation and the pre-consolation with Elected Members and were detailed in section 9.5 of the report.
The Member advised that one of the main complaints that had been received was related to the signage notifications of planning.
The Officer advised that this process had been improved which included weekly Facebook and Twitter post to advertise weekly lists of planning applications, enhanced more eye catching notices, added QR codes so that the public can scan the code and gain access to the planning application, digital displays at the Civic Centre full details listed within the report.
The Portfolio Holder for Regeneration and Growth was pleased that the 17 comments made by the public and those made by the Elected Members had been reviewed and changes made.
The Officer informed the Portfolio Holder for Regeneration that as an authority a review had been completed of other local authorities and Mansfield District Council are exceeding what other authorities are doing.
The Portfolio for Regeneration and Growth was satisfied with the report and responses to questions and authorised the Decision for the Statement of Community Involvement (SCI) 2022 (Appendix A) to be adopted.
