The Committee considered a reserved matters application following Outline Application 2020/0182/OUT (outline planning application for the development of up to 200 dwellings with all matters reserved with the exception of access) - for 199 dwellings, public open space, landscaping and associated infrastructure following approval of outline planning application 2020/0182/OUT for up to 200 dwellings at Land At Three Thorn Hollow Farm, Blidworth Lane, Rainworth.
The application had been deferred at Planning Applications Committee on 9 May, 2022 following discussion, presentations and debate surrounding proposed Plot 81 and existing dwelling No. 21 Farnsworth Avenue, Rainworth, in the context of 'shadow cast' and the intended siting and orientation between the two.
The officer provided a verbal update, reporting that 1 further objection and 1 letter of support had been received since publication of the report. The officer summarised the issues covered in the objection letter and also provided a summary of the changes to the application since the deferral at the May 2022 meeting of the committee. The officer confirmed that the description of the development had been amended to 199 dwellings (previously 200 dwellings) as a result of those revisions.
The recommendation was also verbally updated to include an additional condition to reflect the comments from Environmental Health regarding the impact of shadow flicker form the adjacent wind farm:
Prior to the occupation of any of the dwellings on the following plots (as labelled on approved plans ref. H7799/101 Rev. D), the soft landscaping along the full extent of the western boundary of the site would be installed in accordance with the details shown on approved plan ref. GL 1585 01B and GL1585 02B and the elevational treatment of the dwellings would be treated in accordance with the mitigation measures detailed in section 9 of the Shadow Flicker Assessment produced by Wardell Armstrong dated April 2019 (job no. SH12285): Plots 1-11; Plots 191-193; Plots 198-199. The development would be retained as such thereafter.

The Committee considered an application for 1 No. dwelling at land adjacent to 21 Breckbank, Forest Town.
The officer presented the item and outlined the key material planning considerations.
The recommendation was verbally updated to include an additional Condition to address the potential impact on trees. The wording of the Condition being:
'No works or development shall commence until details of the tree protection measures for the trees to be retained (in accordance with the contents of BS 5837(2012)) have been submitted to and approved in writing by the Local Planning Authority. The approved tree protection measures shall remain in place throughout the duration of the construction works.
Reason: To ensure that the existing trees to be retained are adequately protected during the construction phase of the development, in accordance with policy NE2 (Biodiversity and Geodiversity) of the Mansfield Local Plan and the National Planning Policy Framework.'
During the debate there was discussion about the potential for the existing property at 21 Breckbank and/or the proposed dwelling to be used as a House in Multiple Occupation. After the meeting, the presenting Officer emailed members of the Committee to correct the advice given at the meeting, to confirm that a change of use from a dwelling (use class C3) to a House in Multiple Occupation (HMO) to be occupied by not more than 6 individuals (use class C4) was a material change of use, but would not require planning permission in relation to 21 Breckbank. In relation to the proposed dwelling, that property would have to be occupied first by a single household (use class C3) before it would benefit from the permitted development right to convert to a C4 use. In relation to both properties, a change of use to a HMO to be occupied by more than 7 individuals not living as a single household would require planning permission.
An informative note would be added to the decision notice making it clear that the permission was for a C3 dwelling to be occupied by a single household only so that it was clear what was being approved. That would not prevent a future change to C4 but it would clarify that it could not be occupied as a C4 HMO from first use.
